PetBiz University™, LLC, doing business as PetBizHQ™ (formerly PetBizHQ™) ("Company", "we", or "us") respects your privacy and is committed to protecting it through this Privacy Policy.
This Privacy Policy describes how we collect, use, disclose, and protect personal information when you visit petbizcrm.com and our related websites (the "Website"), when you communicate with us, and when you use the PetBizHQ™ software as a service platform (the "Software"), whether as a guest, a prospective customer, or a registered user.
This policy applies to information we collect on the Website, through the Software, and in email, text, or other electronic messages between you and us. Capitalized terms that are not defined in this Privacy Policy have the meanings given in the PetBizHQ™ Terms and Conditions at https://petbizcrm.com/terms-conditions.
Please read the Privacy Policy carefully. By using the Website or the Software, you acknowledge that you have read this Privacy Policy. If you do not agree with it, please do not access or use the Website or the Software.
We handle personal information in two different capacities, and this policy explains both.
When we collect information about Website visitors, prospective customers, and the pet care businesses that subscribe to the Software (our "Account Holders"), we decide how that information is used. In this capacity we are the business or "controller" responsible for it, and the rest of this policy applies in full.
When an Account Holder uses the Software to store and manage information about their own clients, pets, staff, and contacts ("Customer Data"), including data imported from connected platforms ("Integration Data"), we process that information only on the Account Holder's behalf and according to their instructions. In this capacity we act as a "service provider" or "processor." The Account Holder is responsible for its own privacy practices, and its privacy policy governs how it uses its clients' information. If you are a client of a pet care business that uses PetBizHQ™ and you have questions about your information, please contact that business directly. We will assist them in responding to your request. The section titled How We Handle Customer Data and Integration Data describes the commitments we make for this data.
Our Website and Software are not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Website. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on this Website or on or through any of its features, register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use.
If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at [email protected].
Information You Provide To Us. The Website and Software provide various places for you to provide information. We collect information you provide by filling out forms, creating a Software Account, communicating with us via contact forms, chat, email, phone, or text, responding to surveys, registering for webinars or events, providing comments or other feedback, and ordering a product or service. This information may include your name, business name, email address, phone number, mailing address, billing information, and the content of your communications with us. Payment card information is collected and processed by our payment processor and is not stored on our servers.
Information We Collect Through Automatic Data Collection Technology. As you navigate through our Website and Software, we may use automatic data collection technologies, including Google Analytics, cookies, and pixels, to collect certain information about your equipment, browsing actions, and patterns. This may include your IP address, approximate location derived from your IP address, device type, operating system, browser type, Internet connection, pages viewed, links clicked, referring websites, and the date and time of your visits.
Some of this automatically collected information, such as IP addresses and device identifiers, is considered personal information under many privacy laws, and we treat it accordingly. We use this information to understand how the Website and Software are used, to keep them secure, and to improve our services. If you provide personal information to us, our systems may associate the automatically collected information with it.
Information From Third Parties. We may receive information about you from our service providers, advertising and analytics partners, event and webinar platforms, and referral partners. If you connect a third-party platform to your Software Account, we receive the information that you authorize that platform to share with us, as described below.
Like other commercial websites, our Website uses cookies, pixels, and server logs to collect information about how our site is used. A cookie is a small text file stored on your device that often includes an anonymous unique identifier. Information gathered through cookies and server logs may include the date and time of visits, the pages viewed, time spent at our site, the websites visited just before and just after our own, and your IP address.
We use three types of cookies and similar technologies. Essential cookies are required for the Website and Software to function, such as keeping you logged in and securing your account. Analytics cookies help us understand how visitors use the Website. Advertising cookies and pixels, including social media pixels, allow advertising platforms to measure our ads and show you our ads on other websites and social media.
When you first visit the Website, you can choose to accept all cookies or only essential cookies using our cookie banner, and you can change your choice at any time through the cookie settings link on the Website. You can also block or delete cookies through your browser settings. We honor Global Privacy Control (GPC) browser signals as a request to opt out of the sale or sharing of personal information for advertising purposes. Advertising cookies and pixels are not used inside the logged-in Software in a way that transmits Customer Data to advertising platforms.
Some content or applications on the Website may be served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about your online activities over time and across different websites and online services, and may use this information to provide you with interest-based (behavioral) advertising or other targeted content.
We do not control these third parties' tracking technologies or how they may be used. You can limit this activity by selecting "essential only" in our cookie banner, enabling Global Privacy Control in your browser, or using the industry opt-out tools at optout.aboutads.info and youronlinechoices.eu. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.
If you choose to correspond with us through email or text message, we may retain the content of your messages together with your email address or phone number and our responses. We provide the same protections for these electronic communications that we employ for information received online, by mail, and by telephone.
We do not sell, rent, or lease our subscriber lists to third parties, and will not disclose your email address or phone number to any third parties except as described in the section titled Disclosure of Your Information.
Text Messaging. If you opt in to receive text messages from us, message frequency varies, and message and data rates may apply. You can reply STOP at any time to opt out, or HELP for help. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties, except service providers that help us deliver messages.
PetBizHQ™ may send text messages to Account Holders and prospective customers who have opted in, such as account notices, onboarding and support messages, appointment and event reminders, and, with your consent, marketing messages about our products and services. You opt in by providing your mobile number and agreeing to receive texts through a form on our Website or in the Software, or by texting us a keyword. Consent to receive texts is not a condition of purchasing any product or service. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out, or HELP for help. You can also contact us at [email protected]. Carriers are not liable for delayed or undelivered messages.
We do not sell, rent, or share mobile phone numbers or text messaging opt-in data and consent with third parties or affiliates for their marketing or promotional purposes. Mobile information is shared only with service providers that help us deliver messages. This section does not apply to texts that pet care businesses send to their own clients using the Software; those businesses are responsible for obtaining consent and for their own messaging program.
In compliance with the CAN-SPAM Act and other applicable laws, all emails sent from our organization will clearly state who the email is from and provide clear information on how to contact the sender. All marketing emails will also contain an unsubscribe link so that you can stop receiving marketing communications from us at any time. If you unsubscribe, we may still send you transactional or account-related messages, such as billing notices, security alerts, and changes to our terms.
The Company collects your information in order to record and support your participation in the activities you select. If you register to download a book or resources, sign up for our newsletter, attend a webinar or event, create a Software Account, or purchase a product from us, we collect your information. As a visitor to this Website, you can engage in most activities without providing any personal information. It is only when you seek to download resources and/or register for services that you are required to provide information.
If you are located in the United States and opt to receive any free resources, participate in any free training programs, register for a webinar, register for a live event, register for a seminar, or purchase any products sold by the Company on this Website, we will enroll you to receive our free email newsletter. If you do not wish to receive this newsletter, you can unsubscribe anytime using the link at the bottom of every email.
If you are located outside the United States, including in the European Union, the United Kingdom, Canada, or Australia, we will only enroll you to receive our newsletter or other marketing emails if you affirmatively consent to it. You can withdraw your consent and unsubscribe anytime.
If you ever have trouble unsubscribing, you can send an email to [email protected] requesting to unsubscribe from future emails.
We use personal information about Website visitors, prospective customers, and Account Holders for the following purposes:
(a) to provide, operate, maintain, and support the Website and Software, and to carry out any contract between you and the Company;
(b) to create and manage your Software Account, process payments, and provide customer service;
(c) to send you information about your subscription, account, security, and changes to our services;
(d) to send you marketing communications about our own products, services, education, and events, subject to your choices described in this policy;
(e) to show you advertisements for our products and services on other websites and social media, subject to your cookie and opt-out choices;
(f) to understand how our Website and Software are used and to improve them;
(g) to detect, prevent, and respond to fraud, abuse, security incidents, and violations of our Terms and Conditions; and
(h) to comply with legal obligations and enforce our rights.
From time to time, we may tell Account Holders about products and services offered by third parties that we believe may be useful to their businesses, and we may receive a commission if an Account Holder chooses to purchase. We will only share your information with such a third party if you choose to take part in the offer and consent to the sharing. We never use Customer Data or Integration Data for these offers, and we never market third-party products to an Account Holder's clients.
Customer Data belongs to the Account Holder who submitted it. We process Customer Data and Integration Data only to provide, maintain, secure, and support the Software for that Account Holder, to comply with law, and as otherwise instructed by the Account Holder, in accordance with our Terms and Conditions and our Data Processing Addendum.
We do not:
(a) sell or rent Customer Data or Integration Data;
(b) share Customer Data or Integration Data with any third party for cross-context behavioral or targeted advertising;
(c) use Customer Data or Integration Data to market our own or any third party's products or services to an Account Holder's clients;
(d) use Customer Data or Integration Data to make commission-based or referral offers;
(e) use Customer Data or Integration Data to train, retrain, or fine-tune any artificial intelligence or machine learning model, whether ours or a third party's; or
(f) use Integration Data received from a connected platform for any purpose other than providing the Software to the Account Holder who authorized the connection.
Connected Platforms. Account Holders may connect third-party platforms, such as pet care business management software, to their Software Account. When an Account Holder authorizes a connection, we receive only the data that the Account Holder has authorized and that is needed for the features they enable. We do not request access to premises access credentials, such as lockbox codes, alarm codes, door codes, or key information, or to payment card data. Access tokens for connected platforms are stored in encrypted form. When an Account Holder disconnects a platform, or the platform revokes access, we stop retrieving data within twenty-four (24) hours and delete Integration Data received through that connection within thirty (30) days, unless the Account Holder instructs us to retain specific records in their account or retention is required by law.
We may create aggregated and de-identified data from use of the Software, such as feature usage statistics and system performance metrics, to operate and improve the Software. This data does not identify any Account Holder, client, or individual, and we do not attempt to re-identify it.
The Software includes optional features that use artificial intelligence, such as drafting messages, conversational chat or messaging assistants, AI voice agents, content generation, and summarization ("AI Features"). When an Account Holder uses AI Features, the relevant inputs and Customer Data needed to generate a response are sent to the AI providers that power those features. The AI providers we use are the same providers that HighLevel, the platform on which the Software is built, makes available, and they process this data under the contracts that HighLevel maintains with them.
Under those contracts, our AI providers do not use Customer Data, Integration Data, inputs, or outputs to train or improve their models, and retain such data only as long as necessary to provide the service or for limited abuse monitoring. Account Holders can turn AI Features on or off within the Software.
If you interact with a chat assistant, text conversation, or phone call operated by a pet care business using our Software, that business is responsible for how it uses AI Features, including telling you when you are interacting with an automated system where required by law. We do not use AI Features to make decisions that produce legal or similarly significant effects about any individual. On our own Website, if you chat with an automated assistant, we will tell you that it is automated, and you can ask to reach a person.
We do not sell personal information for money. We disclose personal information only as described below.
Service Providers and Subprocessors. We disclose personal information to companies that help us operate our business and provide the Software, such as cloud hosting, the HighLevel platform on which the Software is built, payment processing, email and text message delivery, telephone services, analytics, customer support tools, and AI providers. These companies may use personal information only to perform services for us and are required to protect it. The Subprocessors that process Customer Data are HighLevel and the same third-party providers that HighLevel engages to deliver its platform, which process that data under the contracts HighLevel maintains with them. Our current list of Subprocessors is available at https://petbizcrm.com/subprocessor-list.
Advertising and Analytics Partners. When you visit our Website, advertising and analytics partners may collect information through cookies and pixels as described above. Under some state privacy laws, this may be considered a "sale" or "sharing" of personal information for targeted advertising. You can opt out as described in the section titled Your U.S. State Privacy Rights. This does not include Customer Data or Integration Data.
At Your Direction. We disclose information when you direct us to, such as when you connect a third-party platform or take part in a third-party offer you have consented to.
Legal Requirements and Protection of Rights. We may disclose information when we, in good faith, believe that the law requires it, when compelled by a court or other governmental entity, or when necessary to protect the rights, property, or safety of the Company, our users, or others, including to a lawyer or collection agency when necessary to enforce our Terms and Conditions or another agreement between you and the Company. Where legally permitted, we will notify the affected Account Holder before disclosing Customer Data in response to a legal request.
Business Transfers. We may transfer information to a successor in interest in the event of a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company's assets or business. Any successor will be required to honor the commitments in this Privacy Policy with respect to information transferred to it, including our commitments regarding Customer Data and Integration Data.
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, or destruction. These include encryption of data in transit using TLS and encryption of Customer Data at rest, role-based access controls that limit access to personnel who need it, encrypted storage of access tokens and API keys, multi-factor authentication options for user accounts, logging and monitoring of access to production systems, and requiring our service providers to maintain appropriate security protections.
If we experience a security breach affecting Customer Data, we will notify the affected Account Holders without undue delay, and in any event within seventy-two (72) hours after confirming the breach, and we will notify any affected connected platform within the same period. We will notify individuals and regulators as required by applicable law.
Email is not a secure medium of communication. For this reason, we ask that you do not send sensitive information to us by email. Payment card information is never transmitted or requested by email. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
For site security purposes and to ensure that our services remain available to all users, the Company uses software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage.
We retain personal information only as long as needed for the purposes described in this policy, unless a longer period is required by law. In general:
(a) Account Holder information is retained while the Software Account is active and for up to three (3) years afterward for tax, accounting, legal, and dispute resolution purposes;
(b) Customer Data is retained while the Software Account is active, made available for export for thirty (30) days after the subscription ends, deleted from active systems within thirty (30) days after that, with copies in backups kept securely isolated from any further processing until they are overwritten in the platform's normal backup rotation;
(c) Integration Data is deleted within thirty (30) days after the connection is removed, as described above;
(d) marketing contact information is retained until you unsubscribe or ask us to delete it, after which we keep only the minimum information needed to honor your opt-out; and
(e) Website analytics data is retained for up to twenty-six (26) months.
You can update your account information within the Software or by contacting us. You can unsubscribe from marketing emails using the link in any email, opt out of text messages by replying STOP, manage cookies through our cookie banner or your browser, and opt out of targeted advertising as described in this policy. You can ask us to access, correct, or delete your personal information by contacting us at [email protected].
Depending on where you live, including California, Colorado, Connecticut, Virginia, Texas, Oregon, and other states with consumer privacy laws, you may have the right to:
(a) know and access the personal information we have collected about you, including the categories of information, sources, purposes, and the categories of third parties to whom it was disclosed;
(b) correct inaccurate personal information;
(c) delete personal information we have collected from you;
(d) receive a copy of your personal information in a portable format;
(e) opt out of the "sale" or "sharing" of your personal information, or its use for targeted advertising; and
(f) appeal our decision if we decline your request.
To opt out of the sale or sharing of personal information for targeted advertising, click the "Your Privacy Choices" or cookie settings link on the Website, select "essential only" in our cookie banner, or enable Global Privacy Control in your browser. To exercise your other rights, email [email protected] with the subject line "Privacy Request." We will verify your request by matching information you provide with information we hold. You may use an authorized agent to submit a request on your behalf, and we may ask the agent for proof of authorization. If we deny your request, you may appeal by replying to our decision, and if you are not satisfied with the outcome of your appeal, you may contact your state attorney general. We will not discriminate against you for exercising any of these rights.
Categories of personal information we collect about Website visitors and Account Holders include identifiers (such as name, email address, phone number, and IP address), commercial information (such as purchase history), internet and network activity (such as browsing and interaction data), approximate geolocation, and professional information (such as business name). We do not collect sensitive personal information about Website visitors or Account Holders for the purpose of inferring characteristics about them.
If you are a client of a pet care business that uses our Software, please submit your request to that business. We will assist the business in responding.
If you are located in the European Economic Area or the United Kingdom, the following additional information applies to personal information we process as a controller.
Legal Bases. We process personal information to perform our contract with you (for example, providing the Software), based on our legitimate interests (for example, securing and improving our services and marketing to business customers, where those interests are not overridden by your rights), based on your consent (for example, non-essential cookies and marketing emails), and to comply with legal obligations.
Your Rights. You have the right to request access to the personal information we hold about you, to correct or erase it, to restrict or object to its processing, and to receive it in a portable format. Where we rely on your consent, you may withdraw it at any time without affecting the lawfulness of processing based on consent before its withdrawal. You also have the right to lodge a complaint with the supervisory authority in the country where you live or work.
International Transfers. We are based in the United States, and personal information may be transferred to and processed in the United States and other countries. When we transfer personal information from the European Economic Area or the United Kingdom, we rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses and the UK International Data Transfer Addendum.
We require only the information that is reasonably required to enter into a contract with you. We will not require you to provide consent for any unnecessary processing as a condition of entering into a contract with us.
We are based in the United States, and personal information is stored and processed mainly in the United States. Some support and operations may be performed from other countries, such as by HighLevel's affiliate in India, under HighLevel's contracts. Where required, we use appropriate transfer safeguards, such as the Standard Contractual Clauses and the UK International Data Transfer Addendum, as described in our Data Processing Addendum. HighLevel states that it participates in the EU-U.S. Data Privacy Framework, its UK Extension, and the Swiss-U.S. Data Privacy Framework.
If you are located in Canada, you may request access to and correction of your personal information, and withdraw your consent to certain processing, by contacting us at [email protected]. Your information may be stored and processed in the United States, where it may be accessible to authorities under U.S. law.
We may update this Privacy Policy from time to time. We will post any changes on this page and update the effective date below. If we make material changes to how we treat personal information, we will notify you by email to the address associated with your account and/or through a notice on the Website or in the Software at least thirty (30) days before the changes take effect. We will not apply material changes to Customer Data that was collected under a previous version of this policy without the Account Holder's consent where consent is required by law. You are responsible for ensuring we have an up-to-date active and deliverable email address for you.
